ButterTrip Terms of Service

Welcome to ButterTrip ("Company," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of our website, mobile application, and related services (collectively, the "Service") operated by ButterTrip LLC.

Please read these Terms carefully. By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use the Service.

IMPORTANT NOTICE FOR U.S. USERS: These Terms contain an arbitration agreement and class action waiver in Section 12, which affects your legal rights. Please read it carefully. You may opt out of the arbitration agreement within 30 days of first accepting these Terms.

1. The Service

ButterTrip is a travel coordination and planning platform that helps users organize trips, share ideas, coordinate with travel companions, and track shared expenses. The Service includes features such as:

Trip Planning & Itinerary Organization: Create and manage trip itineraries
Idea Collection: Save and organize travel ideas from various sources
Email Parsing: Forward confirmation emails to import travel bookings
Expense Tracking: Track and split shared travel expenses
Traveler Network: Connect with travel companions
Community Sharing: Share itineraries publicly (optional)

1.1 Important Disclaimers

BUTTERTRIP IS AN ORGANIZATIONAL TOOL, NOT A BOOKING SERVICE OR SOURCE OF BOOKING TRUTH.

YOU ACKNOWLEDGE AND AGREE THAT:

Accuracy Is Your Responsibility: ButterTrip does not independently verify the accuracy of information you provide or that is extracted from emails and links. You are solely responsible for verifying all travel details with your original booking providers.
AI Parsing May Contain Errors: We use automated systems, including artificial intelligence, to extract information from emails and links you share with us. These systems may produce incomplete or inaccurate results. You must review and verify all extracted information.
We Are Not a Party to Your Bookings: When you save links to third-party services (hotels, airlines, activities, etc.), we simply organize that information. We have no control over those third parties and are not a party to any bookings you make.
Changes Are Your Responsibility: If you change a booking with a third-party provider, you must update ButterTrip accordingly. We are not liable for any issues arising from outdated information in the Service.
No Liability for Missed Travel: BUTTERTRIP SHALL NOT BE LIABLE FOR ANY MISSED FLIGHTS, RESERVATIONS, OR OTHER TRAVEL ARRANGEMENTS RESULTING FROM INACCURATE, INCOMPLETE, OR OUTDATED INFORMATION IN THE SERVICE.

2. Eligibility

2.1 Age Requirement

You must be at least 13 years old to create an account and use the Service. By creating an account, you represent and warrant that you are at least 13 years of age.

2.2 Dependent Information

If you add information about dependents (such as children) to your traveler profile, you represent that you are the parent or legal guardian authorized to provide such information, and you assume full responsibility for the accuracy and appropriateness of sharing that information. PARENTS ARE PROHIBITED FROM SHARING OR FORWARDING CONFIRMATIONS CONTAINING REAL NAMES, PHOTOS, OR PRECISE LOCATION FOR CHILDREN UNDER THE AGE 13.

ButterTrip does not knowingly collect personal information directly from individuals under 13. We do not ask for or store children's names or exact birthdates—only code names and age ranges that you, the adult account holder, choose to provide.

3. Accounts

3.1 Account Creation

To use certain features of the Service, you must create an account. You agree to:

Provide accurate, current, and complete information
Maintain and update your information to keep it accurate
Maintain the security and confidentiality of your login credentials
Notify us immediately of any unauthorized use of your account
Accept responsibility for all activities that occur under your account

3.2 Account Termination

We may suspend or terminate your account at any time, with or without cause, and with or without notice. You may delete your account at any time through your account settings. Upon deletion, we will retain your data for 30 days (in case you change your mind), after which it will be permanently deleted. See our Privacy Policy for more details.

4. User Content

4.1 Your Content

"User Content" means any content you submit, post, or transmit through the Service, including trip plans, itineraries, reviews, comments, ideas, photos, and profile information.

You retain ownership of your User Content. However, by submitting User Content, you grant ButterTrip a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, translate, distribute, and display your User Content in connection with operating and providing the Service.

4.2 Community Sharing

If you choose to share your itineraries publicly, you understand that:

Your shared content will be visible to all users and may appear in search engines. Public sharing is at your discretion; once indexed or copied, we cannot control third-party retention or re-posting
Other users may import your shared itineraries into their own accounts
We may remove certain sensitive information (such as confirmation numbers) before public sharing, but we cannot guarantee complete removal; you are responsible for reviewing shared itineraries and removing any personal or sensitive information before sharing
If you delete a shared itinerary, the public page will be removed, but copies already imported by other users will remain in their accounts
Do not include personal information about other individuals (including travel companions or dependents) unless you have their permission, and avoid sharing highly sensitive data (e.g., government IDs, account numbers, or precise location details for minors)

Disclaimer: Shared itineraries reflect individual user experiences and are not endorsements by ButterTrip. We are not responsible for any harm arising from content shared by other users.

4.3 Content Restrictions

You agree not to submit User Content that:

Is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable
Infringes any intellectual property or privacy rights
Contains viruses or malicious code
Constitutes spam or unauthorized advertising
Impersonates any person or entity

We reserve the right to remove any User Content at our discretion.

5. Expense Tracking & Financial Information

5.1 Expense Coordination Only

The Service provides tools to track and coordinate shared expenses among trip participants. ButterTrip does not process payments. Any actual transfers of money occur outside the Service through third-party payment services (such as Venmo, PayPal, Zelle, or Cash App) that you arrange independently.

5.2 Payment Handle Disclaimer

You may store payment handles (usernames for payment services) in your profile for convenience. ButterTrip does not verify the accuracy of these handles. We are not responsible for incorrect payment handle information or failed transfers. It is your responsibility to confirm payment details directly with your travel companions.

5.3 Expense Dispute Waiver

All expense tracking and calculations within the Service are provided for convenience only. All expense disputes are between users; ButterTrip is not a party to any expense agreements between trip participants. You hereby waive any claims against ButterTrip for expense miscalculations, disputed amounts, or payment failures.

6. Third-Party Services & Links

6.1 Third-Party Links

The Service allows you to save links from third-party websites (such as booking sites, review platforms, and maps). We have no control over these third-party services and are not responsible for their content, privacy policies, or practices.

6.2 Third-Party Bookings

BUTTERTRIP IS NOT A TRAVEL AGENT OR BOOKING SERVICE. Any bookings you make through linked third-party services are between you and those third parties. We have no liability for:

The acts or omissions of third-party travel suppliers
Cancellations, delays, overbooking, or service failures
The accuracy of information on third-party websites
Any disputes between you and third-party providers

6.3 Google Maps

The Service may use Google Maps for location-related features. Your use of Google Maps is subject to Google's Terms of Service and Privacy Policy.

7. Communications

7.1 Service Communications

By creating an account, you consent to receive communications from us related to the Service, including:

Transaction confirmations and account notifications
Trip updates and invitations
Security and privacy notices

7.2 SMS Communications

If you provide your phone number or are invited to a trip by another user, you may receive SMS messages. Standard message and data rates may apply. You can opt out of SMS communications at any time by replying STOP to any message.

If you are invited to a trip but do not have the app installed, we may send you SMS messages only after you explicitly opt in to receive them.

7.3 Marketing Communications

We may send you promotional emails about new features and services. You can opt out at any time by clicking "unsubscribe" in any marketing email.

8. Intellectual Property

8.1 Our Property

The Service, including its design, features, content, and underlying technology, is owned by ButterTrip and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our written consent.

8.2 Feedback

If you provide us with suggestions, ideas, or feedback about the Service, you grant us an unrestricted, perpetual, royalty-free license to use that feedback for any purpose without compensation to you.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY.

WE DO NOT WARRANT THAT:

The Service will be uninterrupted, secure, or error-free
Information extracted from emails or links will be accurate or complete
The Service will meet your specific requirements
Any errors will be corrected

YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

BUTTERTRIP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL.
BUTTERTRIP SHALL NOT BE LIABLE FOR ANY DAMAGES ARISING FROM MISSED TRAVEL, INCORRECT BOOKINGS, OR RELIANCE ON INFORMATION IN THE SERVICE.
OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

11. Indemnification

You agree to indemnify, defend, and hold harmless ButterTrip and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from:

Your use of the Service
Your violation of these Terms
Your violation of any third-party rights
Any User Content you submit

12. Dispute Resolution

12.1 Informal Resolution

Before filing any formal dispute, you agree to first contact us at legal@buttertrip.com to attempt to resolve the dispute informally for at least 30 days.

12.2 Binding Arbitration

If you are located in the United States, any dispute arising from these Terms or the Service that is not resolved informally shall be resolved by binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules.

The arbitration will be conducted in English
The arbitrator's decision will be final and binding
Judgment on the arbitration award may be entered in any court of competent jurisdiction

12.3 Class Action Waiver

YOU AND BUTTERTRIP AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

The arbitrator may not consolidate claims of multiple parties or preside over any form of class or representative proceeding.

12.4 Opt-Out Right

You may opt out of the arbitration agreement within 30 days of first accepting these Terms by sending an email to: legal+optout@buttertrip.com

Your email must include your name, account email address, and a clear statement that you do not agree to the arbitration provision.

12.5 Small Claims Exception

Notwithstanding the above, either party may bring an individual action in small claims court for disputes within that court's jurisdiction.

12.6 Time Limitation

Any dispute must be filed within one (1) year after the claim arose, or it is permanently barred.

13. General Terms

13.1 Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles.

13.2 Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms and updating the "Last Updated" date. Your continued use of the Service after changes take effect constitutes acceptance of the modified Terms.

13.3 Changes to Service

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We shall not be liable to you or any third party for any such modification, suspension, or discontinuation.

13.4 Force Majeure

We shall not be liable for any failure or delay in performing our obligations due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, pandemics, strikes, or failures of third-party services.

13.5 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and ButterTrip regarding the Service.

13.6 Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect.

13.7 No Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

13.8 Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.
